Terms of Use — TwoNest

Last Updated: April 22, 2026

1. Agreement to Terms

By downloading, installing, or using the TwoNest application (the "App") on iOS or Android, you agree to be bound by these Terms of Use ("Terms"). TwoNest is intended for use by adults (18 years or older) who are parents or legal guardians of the children whose information they enter into the App. If you do not agree to these Terms, do not use the App.

2. Who We Are

"Monsware," "we," "us," and "our" mean Monsware, a mobile application studio based in Turkey, operated by Muhammed Şamil Demir. General contact: [email protected].

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial co-parenting purposes on a device that you own or control. You may not copy, modify, reverse-engineer, decompile, disassemble, or create derivative works of the App, except to the extent such restrictions are prohibited by applicable law.

4. Accounts & Family Pairing

TwoNest requires an account. You may sign up with email, Sign in with Google, or Sign in with Apple. You are responsible for keeping your credentials secret and for all activity under your account.

5. Permanence of Records (Important)

Messages, expenses, and swap-request history are permanent. TwoNest intentionally prevents editing or deleting messages, expenses, and swap-request history once submitted. This is enforced in the database, not just the UI. You should treat every message you send and every expense you record as public to the other parent and permanent. If you made an error, the App lets you create a correction entry that references the original — it never rewrites history.

By using the App, you acknowledge and accept this permanence. You agree not to submit content into messages or expenses that you would not want the other paired parent — and, potentially, a court of law — to see later.

6. Evidentiary Use Disclaimer

TwoNest is a record-keeping tool, not a legal service, court-certified provider, or attorney. We do not represent that any specific message, expense record, calendar event, or exported PDF will be admitted as evidence in a legal proceeding. Whether any specific record is admissible in a particular jurisdiction is a question for your attorney and the court. We make no warranty — and accept no liability — regarding the admissibility, weight, or authenticity of exported records in any legal or administrative proceeding.

7. Content & Acceptable Use

You agree not to:

We may remove unlawful content, suspend access, or cooperate with law-enforcement requests as required by applicable law.

8. Subscriptions and In-App Purchases

The App offers a free tier and an optional TwoNest Premium subscription, sold on a monthly or annual basis. Prices displayed in the App are inclusive of VAT/sales tax where applicable.

9. No Advertising

TwoNest does not display ads — on either tier. Your use of the App is supported by subscriptions.

10. Not Legal or Medical Advice

TwoNest is an organizational tool. It is not a legal service, law firm, mediation provider, or medical-records system. Child profile fields (medications, allergies, school info) are conveniences for day-to-day coordination, not a substitute for a medical record or an authoritative source of truth in a medical emergency. Always consult qualified professionals — attorneys, mediators, physicians — for decisions that matter.

11. Intellectual Property

The App, its source code, logo, artwork, icon, and the name "TwoNest" are the property of Monsware and are protected by copyright, trademark, and other laws. No rights are granted to you except the limited license in Section 3. You retain ownership of the content you upload (your messages, receipts, child-profile data) and grant us a limited, non-exclusive license to host, store, back up, and display that content to the other paired parent solely to provide the service. Third-party libraries used in the App are licensed under their respective open-source licenses, available in Settings → About → Open-Source Licenses.

12. Feedback

If you send us feedback, suggestions, or ideas ("Feedback"), you grant Monsware a perpetual, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, and incorporate that Feedback into the App and related materials without obligation or compensation to you.

13. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the App will be uninterrupted, error-free, or that notifications will always be delivered. Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions this paragraph applies to the maximum extent permitted by law and does not affect your statutory consumer rights.

14. Limitation of Liability

To the maximum extent permitted by law, in no event shall Monsware, its founder, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, data, savings, or goodwill — arising out of or in connection with your use of the App. Our total aggregate liability to you for any claim arising from or relating to the App shall not exceed the greater of (a) the amount you have paid us for TwoNest Premium in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 50. Nothing in these Terms limits liability that cannot lawfully be limited (for example, for death or personal injury caused by negligence, fraud, or — in the EU/UK — breach of statutory consumer rights).

15. Indemnification

You agree to defend, indemnify, and hold harmless Monsware from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the App, your infringement of any third-party right, or disputes between you and the other paired parent in which you seek to hold us responsible for the content either of you entered.

16. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice — in particular where you violate Section 7 (Acceptable Use). You may delete your account at any time via Settings → Account → Delete Account. Deleting your account removes you from your family; the shared family record is preserved for the other parent unless they also delete their account, in which case the shared data is purged 30 days later. Sections 4, 5, 6, 10, 11, 13, 14, 15, and 17 survive termination.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, except where mandatory consumer-protection laws in your country of residence grant you the right to bring a claim before your local courts and/or under your local law — in which case those mandatory rights apply.

18. Changes to These Terms

We may update these Terms. When we do, we will revise the "Last Updated" date above. For material changes, we will also show an in-app notice on next launch. Your continued use of the App after the new Terms become effective constitutes your acceptance of them.
